Terms and Conditions of Use for Advertisers

These Conditions shall apply to all services offered by The Jobs Network Limited ("TJN"). By using our Services you agree to be bound by these Terms.

Any other proposed conditions shall be void unless incorporated clearly in written instructions to TJN and specifically accepted by TJN.

For the purpose of these conditions the following definitions apply:

"Advertisement" means a current job vacancy to be displayed on the TJN web site network or otherwise published;
"Advertiser" means the person, firm, charity or corporate body together with any subsidiary or associated Company as defined by the Companies Act 1985 to which placing the order with TJN for the insertion of the Advertisement whether such person be working as an employment business, employment agency or as a direct employer;
"Terms" means these terms and conditions of advertising;
"Company" means The Jobs Network Limited of 2 William Smith Close, Woolstone, Milton Keynes, Buckinghamshire, MK15 0AW. Registered in England No. 06937492, hereafter also detailed as TJN and The Jobs Network;
"Services" means advertising services across TheSalesNetwork.co.uk web sites or any other sites wholly owned and operated by The Jobs Network Limited and its subsidiaries;

Unless the context requires otherwise, references to the singular include the plural.

The headings contained in these Terms of Business are for convenience only and do not affect their interpretation.

Before an advertisement can be placed on The Sales Network an Advertiser account needs to be created and the email address supplied must correlate with the company information for whom you are representing (for tracking purposes we will allow aplitrak and similar email addresses).

In registering with TJN to create an Advertiser account the Client agrees to be bound by the following terms and conditions which apply:

1. The Company reserves the right in its absolute and sole discretion to refuse to offer the Services to any Advertiser, company, firm, individual or organisation.
2. Advertisements are only offered to the Advertiser as a company, firm, charity or other organisation, rather than to individual users or individual business units.
3. Advertisements posted by the Advertiser on The Sales Network can be advertised for up to 84 days (7 days is the default). After this date, they will be automatically archived.
4. Advertisements can only be placed through major job aggregators like Broadbean and Idibu. XML feeds can be accepted at an additional integration charge available upon request.
5. The contents of this Site and all other web sites that are under The Job Network’s control are protected under UK copyright and are the property of The Jobs Network Limited.
6. The Company does not grant authorisation to any Advertiser, user or other the use of its trademarks, logos, text, service marks, or any other copyright works or intellectual property.
7. The Advertiser agrees and acknowledges and that the Company may reject, remove or suspend advertisements at any time and without warning should it so wish.
8. The Advertiser is responsible for proof reading and checking advertisements to be placed onto The Sales Network.
9. The Advertiser agrees and acknowledges that it has obtained all requisite internal approvals that may be required in connection with the Advertisement.
10. The service is offered by the Company in “good faith” and the Advertiser agrees and acknowledges that the Advertisement submitted by the Advertiser for publication:

10.1. is a genuine and currently vacant position as described in the Advertisement and that this is the sole purpose of the Advertisement;
10.2. is not an advertisement for any franchise, MLM, pyramid scheme, ‘get-rich-quick’ scheme or similar;
10.3. is not an posting advertisement for candidates to invest in any kind of business opportunity or directly or indirectly asks for application, training or registration fees;
10.4. is an advertisement of reasonable quality that details accurate job information that is not illegal, inappropriate or fraudulent;
10.5. is a sales and/or marketing vacancy (non sales and marketing advertisements will be removed at TJN’s discretion)
10.6. does not include hyperlinks, a recruiter profile or any text which is self promotional in any way other than in the context of attracting candidates to the specific job vacancy.
10.7. does not contain any material that could reasonably be considered to be defamatory or offensive;
10.8. is not misleading or deceptive to potential candidates or other persons. In particular, the Advertiser warrants that the Advertisement and the Advertiser’s conduct in connection with the Advertisement is not liable to mislead persons seeking the employment as to the availability, nature, terms or conditions of, or any other matter relating to, the employment;
10.9. does not use discriminatory language or requirements;
10.10. does not contravene applicable anti-discrimination laws: including, without limitation: the Data Protection Act 1998, the Sex Discrimination Act 1975, the Race Relations Act 1976, the Disability Discrimination Act 1995, and the Employment Equality (Age) Regulations 2006. The Client shall indemnify the Company against any Losses in connection therewith;
10.11. does not infringe any personal right, copyright, moral right, database right, trade mark, service mark, patent or any other intellectual right held by any party;
10.12. does not carry a risk to any candidate at the location where work is to be performed unless the Advertiser agrees and acknowledges to inform the applicants of such risks and adequate steps are taken to control these risks;
10.13. does not involve working with vulnerable persons, including without limitation persons under the age of 18 or persons in need of care and attention by reason of infirmity, old age, or any other circumstances;

11. For the avoidance of doubt, job posting credits used in the creation or editing of Advertisements not meeting the criteria in clause10 and its sub clauses will not be refunded
12. The Advertiser indemnifies the Company from any claim, loss or liability arising (whether directly or indirectly) in connection with the Advertisement.
13. The Company may, in its sole and absolute discretion, add to, modify or discontinue any of the Services without providing notice to the Client.
14. The Advertiser agrees and acknowledges that the Company do not independently verify information provided by candidates and that the Advertiser must rely on its own enquiries to check or otherwise verify information provided.
15. The Advertiser agrees and acknowledges that they must not post any incomplete, false or inaccurate information, or information that is not their own;
16. The Advertiser agrees and acknowledges to not post any material that contains any viruses, Trojans, worm or similar so as to cause any disruption to The Sales Network;
17. The Advertiser agrees that it is their responsibility to protect their networks and computers against viruses, malware, Trojans, worms or similar.
18. The Advertiser must take all reasonable care to guard against unauthorised use of its user name and password. The Company will not be responsible for any unauthorised access to Advertiser accounts through failure of the Advertiser to take such reasonable care.
19. If the Company permits the Advertiser to advertise free of charge on the websites within The Sales Network you hereby grant the Company an irrevocable, permanent and royalty free licence to use any advertisement that has been submitted by you for placement on the Site or any other third-party website deemed reasonable by the Company for the express purpose of generating user views and applications. This may include reposting onto other sites and feeds not within the Jobs Network or its subsidiaries.
20. The Advertiser must not allow or permit other parties to copy advertisements, or to undertake site scraping or other similar activities unless you have obtained the prior, express permission of the Company.
21. The Advertiser must ensure that their advertisement does not contravene any of the criteria required to adhere to The Employment Agencies Act 1973 and Conduct Regulations 2003. The Advertisement must therefore include, without limitation: a unique job reference number, the nature of work, minimum experience, location, training and/or qualifications to achieve the rate of pay detailed in the advertisement. If the advertiser is an employment agency or employment business they must state in which capacity they are acting on behalf of their client in relation to the vacancy advertisement.
22. The Company shall use all reasonable endeavours to ensure that the sites in The Sales Network are functioning satisfactorily. However, the Company cannot guarantee a continuous error free service and that the web sites will be operational at all times
23. The Company will not be in breach of these Terms if events beyond its reasonable control prevent them from providing the Services
24. In the event that the Advertiser makes a claim against the Company the liability (if any) shall not exceed the price paid by the Advertiser to receive the Services provided by the Company.
25. Under no circumstances shall the Company be liable for any losses, consequential, indirect or special, including without limitation, loss of profits, interest, goodwill, revenue, business and/or savings.
26. Nothing in these Terms shall be construed to exclude the Company’s liability for death or personal injury by negligence or any other liability which cannot by law be excluded.
27. Notices to the company should be sent to info@thesalesnetwork.co.uk and notices in reply will be sent to the email address supplied on the sign up form.
28. Breach by the Advertiser of any of these Terms will result in the Services being withdrawn with no refund or recourse.
29. These Terms are governed by the law of England & Wales and are subject to the exclusive jurisdiction of the Courts of England & Wales
